New Jersey Statutes of Limitations
Statutes of limitation prevent the state from prosecuting cases that are considered to be untimely. In general, the statute of limitations for a criminal offense in New Jersey is five years. However, some crimes, such as murder or rape, can be prosecuted at any time. Others are significantly less than the standard five years such as disorderly persons charges which must be prosecuted within one year of the alleged offense.
It is important to remember that, if a suspect flees, the statue of limitations is suspended in order to avoid suspects fleeing to wait out the statute of limitations.
