Courts in New Jersey A small business owner can find themselves in several different courts in New Jersey. If the dispute is over money damages, you will be in civil court. If the amount if under $15,000, you will be in the Special Civil Part. If the amount is over $15,000, you will be in the Civil Part. Special Civil cases are handled much faster than other civil cases. However, not all disputes concern money damages. Some parties may be seeking to enforce their rights; that is, they want a court to order a defendant to do something. These cases are called General Equity cases. Due to the complexity of these cases, usually some of the best judges sit in the General Equity Part. Administrative Courts In New Jersey, the executive branch has numerous departments and agencies that can stop a business from doing something, force them to do something or fine them for numerous violations. When a business owner disputes their actions, the case is brought before an Administrative Law Judge. This is a completely separate court system than the New Jersey Judiciary. There is no jury and the ALJ issues a decision at the end of the case. The executive department or agency has the power to accept or reject the decision.
