My client was facing 20 years in prison for attempted murder, 10 years for aggravated assault with a firearm, 10 years for carrying a firearm without a permit, and 10 years for possessing a firearm for an unlawful purpose to use it against someone, please guilty to one count of aggravated assault for a sentence of 6 years in prison. He will be given credit for time served of 1 ½ years at the time of his sentencing.

Recently, a client charged with soliciting prostitution at a massage parlor had his charges dismissed; a client charged with endangering a minor accepted a guilty plea to a petty misdemeanor of disorderly conduct; and a client charged in three indictments with aggravated assault, money laundering and possession of a firearm, accepted a guilty plea to assault theft and imitation firearm.

After a 3-day trial, a jury found my client, D.H., not guilty of possession of a handgun. After being stopped for a motor vehicle violation, my client’s car was searched, and a handgun was found in a back pack on the passenger seat. The officer testified that DH had retrieved his motor vehicle credentials from the same back pack. D.H. testified that he retrieved his credentials from the glove box, and that the back pack was given to him by his brother to return to a friend of his brother’s at a local pharmacy. The mobile video recording of the stop did not indicate any mention of my client going into the back pack for credentials.

After deliberating for an hour, the jury asked for the MVR to be replayed. After the replay, the jury deliberated just 10 more minutes before returning a unanimous not guilty verdict.

After a 3-day trial, a jury found my client, J.M., not guilty of sexual assault, sexual contact, aggravated assault, assault with domestic violence, robbery or burglary. The complainant claimed JM broke into her apartment, smothered her, put his fingers into her rectum and forcibly stole her cell phone, the day after she egged his car the night before. Cross-exam showed she never went for her sexual assault medical exam, choosing instead to go to the nail salon with her friend the next day.

I represented a nurse who was charged with possessing a prohibited devise/weapon i.e., a police baton/nightstick in Burlington. It seemed like a case of racial profiling. A trooper stopped her for tinted windows, claimed he smelled raw marijuana so he had cause to search the car. My client was arrested and cuffed. The trooper found no marijuana, but found the baton, which my client admitted was hers.

After speaking with the county prosecutor the charge was downgraded to disorderly conduct and remanded to municipal court. After speaking with the municipal prosecutor, he downgraded the charge to a township ordinance. My client pled guilty to a $200 fine and will be able to keep her nurse’s license.
